Delta VIO Operations Remain Legal Despite Abuja Court Ruling

The Delta State Vehicle Inspection Office (VIO) has clarified that the recent court judgment delivered in Abuja does not in any way invalidate or restrict its operations within Delta State.

The Director of the Vehicle Inspection Office,(VIO), Engineer Vincent Ehiwario, made this known while interacting with journalists in Asaba, stating that the ruling of the Federal High Court in Abuja applies strictly to the Federal Capital Territory (FCT) and does not override the powers granted to Delta State under its existing traffic laws.

According to him, Nigeria operates a federal system of government, where states have the constitutional authority to enact and enforce their own traffic and transportation regulations through the State House of Assembly.
He explained that the activities of the Delta State VIO are backed by state laws, which empower officers to conduct vehicle inspections, enforce roadworthiness compliance, and ensure safety on public roads.

“The judgment delivered in Abuja does not nullify the legal framework guiding VIO operations in Delta State,” he said. “Our mandate is clearly established under the laws of Delta State, and we will continue to discharge our responsibilities in accordance with those laws.”

The Director emphasised that the VIO does not arbitrarily create fines or penalties but strictly enforces provisions as stipulated in the state’s traffic regulations. He noted that vehicle impoundment and related sanctions are lawful enforcement measures aimed at promoting safety, reducing accidents, and ensuring compliance with road traffic standards.

He urged journalists to accurately report the position of the Delta State Government to avoid misinformation that could mislead motorists. The Director specifically stressed that any motorist on Delta State roads who disobeys, obstructs, or assaults a VIO officer in the course of performing his statutory duties will be prosecuted.

He warned that the state government will not tolerate acts of violence or defiance against traffic enforcement officers and that offenders will face the full weight of the law.

While calling on motorists to remain law-abiding, the Director encouraged drivers to ensure their vehicles are roadworthy and properly documented to avoid sanctions. He reiterated the VIO’s commitment to professionalism, fairness, and adherence to due process in carrying out its duties.

The briefing comes amid public reactions to the Abuja court ruling, with the Delta State VIO reassuring residents that its operations remain fully legal and operational within the state.
