In order to safeguard themselves and the government from unintended embarrassing repercussions, the Delta Solicitor-General and Permanent Secretary , Ministry of Justice, Mr Omamuzo Erebe, (SAN), has warned civil servants against acting beyond lawful powers.
He urged civil servants to uphold the rule of law in the discharge of their official responsibilities.
Erebe gave the charge while delivering a lecture at the ongoing 9th Inter-Cadre Transfer and Inter-Service Transfer Training Programme and Aptitude Test for shortlisted officers in the Delta State Public Service.
Speaking on the theme, “Principles of Common Law for Public Servants,” he said a sound understanding of common law principles was essential for lawful and effective decision-making in the public service.
He highlighted reasonableness, legitimate decision-making and the need for public officers to act within the limits of their statutory powers.
Erebe cautioned civil servants against arbitrary or unreasonable decisions, urging them to be objective and guided by legitimate expectations when exercising their official duties.
He also explained the principle of ultra vires, which refers to an action taken beyond the powers or authority conferred on an officer by law.
The Solicitor-General warned that public officers who acted outside their lawful powers could expose themselves and the government to serious legal consequences.
“An officer cannot exceed the power given to him by law. If you act ultra vires, the government may not be able to protect you. Your decision must be supported by reasons and backed by law,” he said.
Erebe added that official decisions should have a clear legal basis and be taken in good faith.
He stressed that adherence to the principles would promote accountability, discipline and professionalism in the civil service.
The training programme was formally declared open by the Head of Service, Dr (Mrs) Mininim Oseji.
Oseji said the programme was designed to prepare officers transitioning into the officer and assistant cadres by equipping them with relevant knowledge, contemporary management concepts and practical skills for efficient and effective service delivery.
